Heavy ART construction started on Central Avenue in Albuquerque

Heavier construction just took off on the Albuquerque Rapid Transit or ART project to create a dedicated nine-mile bus lane on busy Central Avenue. Last week, we shared information about the dangerous Central-San Mateo intersection. As we said, Central Avenue is part of historic Route 66, serving as a major east-west corridor.

According to KOAT Albuquerque, this project along Central Avenue will continue for another year, bringing lane closures, median removal and traffic delays.

Drivers always have the legal duty to drive carefully and reasonably under the circumstances to prevent harm to others. In a construction zone, what is careful and reasonable driving can rise to a higher level of care because of increased and unexpected obstacles, unexpected traffic stops, construction workers in close vicinity to traffic, narrowed lanes and reduced speeds.

Drivers who drive negligently or recklessly in these work-zone conditions could be liable for physical injury, property damage or even death in resulting motor vehicle accidents.

The Federal Highway Administration reports these facts about work-zone accidents in which deaths occurred nationally based mostly on 2013 data:

· Almost half of fatal work zone accidents happen on urban interstates and arterials even though these kinds of city roads are only five percent of total roads.

· More than 40 percent of fatal work zone crashes were rear-end collisions, despite rear-end crashes being only 16 percent of all other kinds of fatal accidents.

· About one-quarter of work-zone deaths from accidents involved large trucks, as compared to only 12 percent that involved large trucks in all kinds of crashes.

Under New Mexico law, it is a misdemeanor to walk or drive through a construction zone without obeying all "signs, signals, markings, flagmen or other traffic-control devices that are placed to regulate, control and guide traffic ..." Violation of this law could bring an automatic finding of negligence in a civil lawsuit for resulting injuries.
